KREEVA may also change, introduce or impose fees for products, premium listings and services provided through the Website at any time, at its sole discretion. KREEVA may establish or change, at any time, general practices and restrictions concerning other KREEVA products and services at its sole discretion.

KREEVA Privacy Notice

With respect to any individual whose personal information/data is provided by You to KREEVA, You represent and warrants that You have obtained all necessary prior consents for the processing, tracking and storage of such personal information/data as contemplated by the Services and Kreeva’s Privacy Policy.

Telecommunication & DND Waiver

By providing Your contact details (including phone number and email address) on the Website, You expressly consent to receive communications, calls, text messages, and automated digital alerts (including WhatsApp messages) from KREEVA or its authorized channel partners regarding property updates, project details, and promotions. You hereby waive any registration under the National Do Not Call (NDNC) Registry or Telecom Commercial Communications Customer Preference Regulations (TCCCPR).

Licence and Ownership

Any and all intellectual property rights (including copyrights, trademarks, trade secrets, patents, layout and design, collectively referred to as “Intellectual Property”) associated with the Website and its contents (the “Content”) are the sole and exclusive property of KREEVA, its group affiliates or licensed third parties. The Content is protected by Intellectual Property laws and other applicable statutes in India. Termination

Compliance With Law including Export Control

You explicitly agree and covenants to use the Website, contents and Services in strict compliance with all applicable local, state, and national laws, rulings, and regulations. This includes, but is not limited to, the Real Estate (Regulation and Development) Act, 2016 (RERA), the Haryana Real Estate Regulatory Authority (HRERA) guidelines and the Information Technology Act, 2000, and the Digital Personal Data Protection (DPDP) Act, 2023.

You shall not utilize the Website in any manner that, in the sole and absolute judgment of KREEVA, negatively reflects upon, dilutes, or damages the goodwill, brand equity, or corporate reputation of KREEVA, its promoters, or its projects. Governing Law and Jurisdiction

Any dispute, controversy, or claim arising out of or relating to these Terms of Use including their existence, validity, interpretation, performance, breach, or termination shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The dispute shall be adjudicated by a sole arbitrator mutually appointed by KREEVA and You, with the Seat and Venue of arbitration strictly established in Gurugram, Haryana, India, and conducted in the English language. Subject to the aforementioned arbitration framework, and for any matter requiring judicial intervention, the appropriate courts located in Gurugram, Haryana, India, shall hold exclusive territorial and subject-matter jurisdiction, and You hereby explicitly waive any objection to such courts on the grounds of venue or an inconvenient forum.

General

You may not assign, delegate or transfer these Terms of Use or any of Your interests, rights or obligations under these Terms of Use without any prior explicit written consent of KREEVA, and any unauthorized assignment shall be null and void ab initio; provided, however, that KREEVA, and reserve the unrestricted right to transfer or assign its rights and obligation to any affiliate or successor-in-interest without Your consent. If any provision of these Terms of Use is held to be invalid, illegal or unenforceable by any court or arbitral tribunal having competent jurisdiction, such invalidity shall not affect or impair the validity or enforceability of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No failure, delay, waiver, or partial exercise of any rights by KREEVA shall operate as a waiver thereof, and no waiver of any single breach shall be deemed a further or continuing waiver of that or any other provision. These Terms of Use constitute a legally binding electronic contract under the Information Technology Act, 2000, and You hereby explicitly waive any requirement or right demanding that these Terms of Use be executed via physical signatures or proved by means of a physical, written document to establish their validity, enforceability, or admissibility in evidence.
